TERMS & CONDITIONS

By using the services of Marblehead Custom Jewelry ("Jewelry Store"), including purchasing products or submitting items for repair, appraisal, or any other services, you ("Customer") agree to the following terms and conditions:
1. General Terms:
- The Jewelry Store reserves the right to modify or update these Terms and Conditions at any time without prior notice. Any changes will be posted on our website.
- By continuing to use the Jewelry Store's services, the Customer agrees to abide by the updated Terms and Conditions.
2. Product Availability:
- All products displayed on the Jewelry Store's website or in-store are subject to availability. In the case of stock shortages, the Jewelry Store will notify the Customer and offer alternative options or a full refund.
3. Pricing and Payments:
- Prices are subject to change without notice. The Jewelry Store will notify Customers of any changes before processing the transaction.
- Payments for products and services are accepted via cash, credit card, personal or bank check (may have to verify bank), PayPal, Venmo, Zelle, wire transfer, Quickbooks/Invoicing.
- The Jewelry Store will process orders after payment has been confirmed.
4. Returns and Exchanges:

- We do not offer refunds. All sales are final. Exchanges subject to item availability.
- If you receive a defective, damaged, or incorrect item, please notify us within 14 days with a photo and description of the issue. We will provide a replacement or a full refund, including shipping fees, if the item is confirmed to be defective, damaged or incorrect.
5. Liability:
- The Jewelry Store is not liable for any damages, injuries, or losses incurred through the use of our products, including but not limited to physical harm or loss of property.
- The Jewelry Store does not guarantee the accuracy of the descriptions, pricing, or images of the products, although we strive for accuracy.
6. Customer Responsibilities:
- The Customer is responsible for providing accurate information when placing orders, including shipping addresses.
- The Customer agrees to follow the care instructions provided with their jewelry to ensure its longevity.
7. Intellectual Property:
- All content on the Jewelry Store’s website, including images, text, and logos, is owned by the Jewelry Store and protected by intellectual property laws. Customers may not reproduce or use this content without express written permission.
8. Governing Law:
- These Terms and Conditions shall be governed by and construed in accordance with the laws of the state of Massachusetts.

SHIPPING & DELIVERY AGREEMENT

1. Shipping Methods and Charges:
- The Jewelry Store offers the following shipping options: standard (ground), expedited (2-3 day), overnight.
- Shipping charges are calculated based on the destination, weight, and delivery method. The Jewelry Store will provide an estimated shipping cost during checkout.
2. Shipping Time:
- Orders are typically processed and shipped within 2-3 business days from the date of purchase. Delivery times may vary based on the shipping method and destination.
- We do not guarantee delivery dates, though we strive to meet the expected delivery timeframe.
3. Order Tracking:
- Once an order is shipped, the Customer will receive a tracking number via email to monitor the progress of the delivery.
- Customers are responsible for tracking their orders and ensuring they are available to receive the package. If a package is lost or delayed due to customer error (e.g., incorrect address), the Customer may incur additional shipping charges.
4. International Shipping:
- The Jewelry Store ships internationally. International shipping fees will vary depending on the destination and are calculated during checkout.
- The Customer is responsible for any customs duties, taxes, or fees imposed by the destination country.
5. Damaged or Lost Items:
- If an item arrives damaged, the Customer must report it within 10 days of receiving the package. We will arrange for a return and replacement or a refund, depending on the circumstances.
- If an item is lost during shipping, the Customer should contact the Jewelry Store within 10 days to file a claim. We will work with the shipping carrier to resolve the issue.
6. Return Shipping:
- Customers are responsible for the return shipping costs for any items being returned or exchanged, except in cases where the item is damaged or defective upon arrival.
- Returned items must be in their original condition and packaging. Failure to return items in the required condition may result in a refusal of the return or an additional restocking fee.
7. Shipping Address:
- The Customer is responsible for providing an accurate and complete shipping address. If an incorrect address is provided, the Customer will be responsible for any additional shipping costs or delays incurred.
8. Risk of Loss:
- Risk of loss or damage to products passes to the Customer once the item has been shipped, unless otherwise agreed upon.
Custom Order Terms
CUSTOM ORDER TERMS
Effective Date: 1/1/2025
This Custom Order Agreement ("Agreement") is made between Marblehead Custom Jewelry ("Seller"), located at 66 Washington St/Marblehead, MA 01945, and purchaser or “customer”, for the creation and purchase of a custom jewelry piece as described below.
1. Custom Order Details. Following must be detailed on custom intake slip or envelope.
1.1 Description of Item: [Detailed Description]
1.2 Materials Used: [Gold, Silver, Diamonds, Gemstones, etc.]
1.3 Design Specifications: [Engraving details, size, weight, etc.]
1.4 Estimated Completion Date
2. Payment Terms 2.1 Total Estimated Price: estimated price and budgeting will be discussed during project intake and noted on form/envelope 2.2 Deposit: A non-refundable deposit of 50% is required at the time of order placement or a non-refundable $500 design fee. 2.3 Final Payment: The remaining balance is due upon completion and before the item is delivered to the Customer.
3. Production Timeline 3.1 The estimated time for completion is 8-12 weeks weeks from the date of deposit receipt, unless otherwise stated. 3.2 Delays may occur due to unforeseen circumstances, and the Customer will be notified of any changes to the timeline.
4. Approval Process 4.1 The Customer will receive design proofs or prototypes (if applicable) for approval before production begins. 4.2 Once approval is given, no further modifications can be made without additional charges and potential delays.
5. Return & Cancellation Policy 5.1 Due to the custom nature of the order, all sales are final and non-refundable. 5.2 If the order is canceled before production begins, the non-refundable deposit will be retained by the Seller. 5.3 If the order is canceled after production has begun, the Customer is responsible for the full balance.
6. Warranty & Repairs 6.1 The custom piece is covered under a 6-month to 1-year* warranty for craftsmanship defects unless otherwise stated. *To receive 1 year warranty you must schedule and have your custom piece checked at the 6 month mark. We will clean and inspect your item and extend your warranty an additional 6 months.* (mail-in or walk-in options available). Entire warranty not to exceed one year from pick up date. 6.2 Repairs due to normal wear and tear will be subject to additional costs.
7. Liability Disclaimer 7.1 The Seller is not responsible for damage caused by improper handling, accidents, or modifications made by third parties. 7.2 The Seller guarantees the authe-nticity of materials used but does not guarantee against natural wear over time.

1. Purpose
This Agreement outlines the terms under which Marblehead Custom Jewelry ("Jewelry Store") provides repair services and warranties for Customer-owned jewelry.
2. Repair Services
Repairs may include but are not limited to: resizing, stone replacement, cleaning, polishing, clasp/chain repairs, and other necessary work.
3. Repair Process
- The Customer submits jewelry for inspection.
- The Jewelry Store provides a repair estimate (labor, parts, materials).
- The Customer must approve and authorize repairs in writing before work begins.
4. Payment Terms
- Repair fees are due upon completion unless otherwise agreed.
5. Warranty on Repairs
- 6-month warranty on craftsmanship and materials.
- Warranty covers defects in workmanship but excludes:
- Damage from misuse, accidents, improper care, or unrelated wear and tear.
- Loss or theft of jewelry.
If a defect arises within the warranty period, the Jewelry Store will, at its discretion:
- Repair the item at no charge.
- Replace parts (subject to availability).
Warranty void if repairs are performed by a third party.
6. Turnaround Time
- Estimated completion dates depend on complexity and material availability.
- The Jewelry Store will notify the Customer of any delays.
7. Liability
- The Jewelry Store is not responsible for pre-existing conditions or unforeseen damage.
- Customers should insure jewelry for its full value during repairs.
8. Risk of Loss
- The Jewelry Store is not responsible for loss, theft, or damage unless due to negligence.
- Customers are advised to insure items while in transit or at the store.
9. Confidentiality
- Both parties agree to maintain confidentiality regarding the jewelry’s design, materials, and value.
10. Termination
- Customers may cancel before repairs begin.
- If work has started, the Customer is responsible for incurred costs.
- The Jewelry Store may terminate the Agreement if payment is not made.
11. Governing Law
This Agreement is governed by the laws of Massachusetts.
By entrusting jewelry with Marblehead Custom Jewelry, the client agrees to all terms and conditions outlined above.

Return & Exchange Policy
EXCHANGE POLICY
Effective Date: 1/1/2025
At Marblehead Custom Jewelry, we value our customers and strive to ensure satisfaction with every purchase. If you are not completely satisfied with your purchase, we offer the following exchange policy:
1. Eligibility for Exchange 1.1 Exchanges are allowed within 14 days for items of equal or greater value, with any price difference paid by the customer, and/or store credit. 1.2 Items must be in their original condition, unworn, and with all original packaging, tags, and receipts. 1.3 Custom-made, engraved, or personalized jewelry is not eligible for exchange. 1.4 Sale and clearance items are final sale and cannot be exchanged. 1.5 Shipping fees are non-refundable. 1.6 We do not offer refunds. All sales are final. Exchanges subject to item availability. 1.7 Items must be in original condition received.
2. Exchange Process 2.1 To initiate an exchange, please contact us at info@marbleheadcustomjewelry.com / 413-238-1383 for an exchange authorization. 2.2 Exchanges must be shipped to 66 Washington St, Marblehead, MA 01945 or exchanged in-store. 2.3 Customers are responsible for shipping costs unless the item is defective or incorrect.
3. Damaged or Defective Items 3.1 If you receive a defective or damaged item, please notify us within 14 days with a photo and description of the issue. 3.2 We will provide a replacement or a full refund, including shipping fees, if the item is confirmed to be defective.
4. Exceptions & Special Conditions 4.1 Gift recipients will receive store credit if they choose to return an item. 4.2 We reserve the right to refuse returns that do not comply with this policy.
