By using the services of Marblehead Custom Jewelry (“we,” “us,” “our”)—including visiting our website, purchasing products, placing custom orders, or submitting items for repair or appraisal—you (“Customer,” “you”) agree to the following Terms & Conditions, along with any additional policies referenced here (including our Custom Order Terms & Conditions, Return & Exchange Policy, Jewelry Repair & Warranty Terms, Shipping & Delivery Agreement, and Privacy Policy).
1. General Terms
1.1 Updates to Terms
We reserve the right to modify or update these Terms & Conditions at any time. Updates will be posted on our website and will take effect immediately upon posting, unless a later effective date is stated.
1.2 Acceptance of Terms
Your continued use of our website or services, or your purchase of products or services after changes are posted, constitutes acceptance of the updated Terms & Conditions.
1.3 Additional Policies
Certain services (for example, custom work, repairs, shipping) are also governed by specific policies referenced in this document. If there is a conflict between these Terms & Conditions and a more specific policy for a particular service, the more specific policy will generally control for that service.
2. Product Availability
2.1 Availability
All products shown online or in‑store are subject to availability at the time of purchase.
2.2 Substitutions & Cancellations
If an item is unavailable or delayed, we will notify you and may offer an alternative item, store credit, or a refund of amounts paid for that item, in accordance with our Return & Exchange Policy.
3. Pricing & Payments
3.1 Pricing
- Prices may change without notice.
- Any price change affecting your order will be communicated before your transaction is processed or before we proceed with work.
3.2 Accepted Payment Methods
We accept the following payment methods, subject to availability and our discretion: cash, major credit cards, PayPal, Venmo, Zelle, wire transfer, and QuickBooks invoice payments. Checks accepted on a case by case basis.
3.3 Payment Timing
- Orders and services will generally begin once payment is received and confirmed.
- For certain services (such as custom work), deposits or staged payments may be required and will be detailed in the relevant policy or intake form.
3.4 Deposits
For custom work and some special orders, deposits are non‑refundable, unless otherwise stated in writing or as required by law. Please see the Custom Order Terms & Conditions for specific details.
4. Returns, Exchanges & Order Issues
Please review our separate Return & Exchange Policy for detailed information on eligibility, timeframes, and processes for returns and exchanges.
- Custom, engraved, and certain final‑sale items are generally not eligible for return or exchange, except as required for defective merchandise.
- If you believe an item is defective or does not conform to your order, you must notify us within the timeframe stated in the Return & Exchange Policy so we can inspect and address the issue.
5. Repairs, Custom Work & Customer Property
Services involving custom orders, repairs, or work on Customer‑owned jewelry are subject to additional terms:
- Custom Order Terms & Conditions govern design approvals, deposits, final sale status, and warranty for custom pieces.
- Jewelry Repair & Warranty Terms & Conditions govern repair estimates, warranties on repair work, pre‑existing conditions, and risk of loss for items left in our care.
By placing a custom order or submitting an item for repair or appraisal, you agree to the applicable policy in addition to these Terms & Conditions.
6. Limitation of Liability
6.1 General Limitation
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to our products or services is limited to the amount you paid us for the specific product or service at issue.
6.2 No Indirect or Consequential Damages
We are not liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of use, loss of profits, emotional distress, or loss of sentimental value, arising from the use or inability to use our products or services.
6.3 Accuracy of Information
We strive for accuracy in product descriptions, pricing, images, and other information, but we do not guarantee that all such information is error‑free. In the event of an error, we reserve the right to correct the error and, if necessary, cancel or adjust an order after notifying you.
6.4 Legal Rights Preserved
Nothing in these Terms & Conditions is intended to waive or limit any non‑waivable statutory rights you may have under Massachusetts or federal law, including rights related to defective goods or unfair/deceptive practices.
7. Customer Responsibilities
7.1 Accurate Information
You agree to provide accurate and complete contact, payment, and shipping information, and to promptly update us if your information changes.
7.2 Care & Use of Jewelry
You are responsible for reviewing and following recommended jewelry care instructions to maintain the condition and longevity of your items (for example, periodic inspections, avoiding harsh chemicals, appropriate storage).
7.3 Disclosure of Prior Work & Treatments
When submitting items for repair, appraisal, or custom work using existing stones or metal, you must disclose any known:
- Previous repairs or structural concerns;
- Treatments (such as fracture‑filled or heavily included gems);
- Plated metals or other non‑standard materials.
This helps us evaluate risk and determine whether the requested work is appropriate.
8. Intellectual Property
8.1 Ownership
All website content—including images, product photos, designs, text, logos, and branding—is the property of Marblehead Custom Jewelry or its licensors and is protected by applicable intellectual property laws.
8.2 Limited Use
You may view and use our website and materials only for personal, non‑commercial purposes related to shopping or learning about our services. Any unauthorized use, reproduction, modification, or distribution is strictly prohibited without our prior written permission.
8.3 Custom Designs
Unless otherwise agreed in writing, we retain all rights, title, and interest in and to any original designs, sketches, CAD files, or concepts we create, even when those designs are used to produce your jewelry. We reserve the right to photograph, reproduce, or adapt design elements (excluding your personal names, dates, or highly identifying details) for our portfolio, marketing, or future collections.

These Terms & Conditions are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles.
9.2 Dispute Resolution
If a dispute arises, we encourage you to contact us first so we can attempt to resolve the issue informally. If we cannot resolve it, any legal action must be brought in the appropriate state or federal courts located in Massachusetts, subject to applicable consumer protection laws.
