These Terms of Service (“Terms”) govern your participation in the Monthly Raffle (“Raffle”) sponsored by Marblehead Custom Jewelry, located in Marblehead, Massachusetts (“Sponsor,” “we,” “us,” or “our”). By submitting your information through our online contact form, you (“you,” “participant,” or “entrant”) agree to be bound by these Terms.
1. Eligibility
The Raffle is open only to legal residents of the United States who are 18 years of age or older at the time of entry. The Raffle is void where prohibited by law. Employees, agents, or affiliates of Marblehead Custom Jewelry and their immediate family or household members are not eligible to enter.
2. How to Enter
To enter the Raffle:
- Submit your name and email address using the designated online contact form.
- Submission of a phone number is optional.
- Only one (1) entry per person per calendar month is permitted.
- Duplicate or incomplete entries may be disqualified at the Sponsor’s sole discretion.
No purchase is necessary to enter or win.
3. Raffle Schedule & Winner Selection
- The Raffle is conducted monthly, with a new winner selected each calendar month.
- One (1) winner will be chosen at random from all eligible entries received during that month.
- Odds of winning depend on the total number of eligible entries received.
4. Prize
- The prize is determined solely by Marblehead Custom Jewelry and may include, but is not limited to, free jewelry, store merchandise, or in-store discounts.
- Prizes have no cash value, are non-transferable, and may not be substituted or redeemed for cash or credit.
- The winner must visit the store in person to claim the prize. Prizes will not be shipped or delivered.
5. Winner Notification & Claiming Prize
- The winner will be notified via the email address (or phone number, if provided) submitted with the entry.
- The winner must respond within 7 days of the notification to claim the prize.
- If the winner does not respond in time or is otherwise disqualified, an alternate winner may be selected.
- Winner Email must be presented to and approved by an employee of Marblehead Custom Jewelry. Valid ID may be required to claim the prize in-store.
6. Consent to Communications
By entering the Raffle, you consent to receive communications from Marblehead Custom Jewelry regarding the Raffle, future promotions, and marketing updates. You may unsubscribe at any time using the link provided in our emails/SMStext. Your personal information will be handled in accordance with our [Privacy Policy].
7. Publicity Release
By accepting a prize, you grant Marblehead Custom Jewelry permission to use your first name, city/town, and, if voluntarily provided, a photo taken at prize pickup for marketing or promotional purposes without additional compensation, unless prohibited by law.
8. General Conditions
- We reserve the right to cancel, modify, or suspend the Raffle at any time for any reason, including fraud, technical issues, or force majeure events.
- We are not responsible for incorrect or inaccurate entry information, technical errors, or unauthorized tampering with the entry process.
- We reserve the right to disqualify any individual found to be violating these Terms or manipulating the Raffle.
9. Limitation of Liability
By participating, you release and hold harmless Marblehead Custom Jewelry, its owners, employees, and agents from any and all liability, loss, or damage incurred in connection with participation in the Raffle or the acceptance, use, or misuse of any prize.
10. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles. Any disputes arising from this Raffle will be subject to the exclusive jurisdiction of the courts located in Essex County, Massachusetts.
